WAIVER AND RELEASE OF LIABILITY AND AGREEMENT TO PARTICIPATE IN ACTIVITY WITH:
FOUNDATIONS JIU JITSU LLC
IN THE MARTIAL ART STYLES OF BRAZILIAN JIU JITSU, JUDO, WRESTLING, SUBMISSION GRAPPLING

1. Acknowledge that I am familiar with the sport of Brazilian Jiu-Jitsu / Judo / Wrestling / Submission Grappling and understand the rules governing the sport of Brazilian Jiu-Jitsu / Judo / Wrestling / Submission Grappling

2. Agree that prior to participating, I will inspect the mats, equipment, facilities, and if I believe anything unsafe or beyond my capability, I will immediately advise my coach, supervisor of such conditions and refuse to participate.

3. Acknowledge and fully understand that I will be engaging in a contact sport that might result in serious injury, including permanent disability or death, and severe social and economic losses due to not only my own actions, inaction’s or negligence, but also to the actions, inaction’s or negligence of others, the rules of the sport Judo/wrestling/submission grappling, or conditions of the premises or of any equipment used. Further, I acknowledge that there may be other risks not known to me or not reasonably foreseeable at this time.

4. Knowing the risks involved in the sport of Brazilian Jiu-Jitsu / Judo / Wrestling / Submission Grappling, I assume all such risks and accept personal responsibility for the damages following such injury, permanent disability, or death.

5. Release, waive, discharge and covenant not to sue the Foundations Jiu Jitsu LLC, together with their affiliated clubs, their respective administrators, directors, agents, coaches and other employees or volunteers of the organization, events officials, medical personnel, other participants, their parents, guardians, supervisors and conduct the event, all of whom are hereinafter referred to as “releasee”, from any and all claims, demands, losses, or damages on account of injury, including permanent disability and death and damage to property, caused or alleged to be caused in whole or in part by the negligence of the releasee or otherwise to the fullest extent permitted by law.

I HAVE READ THE ABOVE WARNING, WAIVER AND RELEASE, UNDERSTAND THAT I GIVE UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND KNOWING THIS, SIGN VOLUNTARILY. I AGREE TO PARTICIPATE KNOWING THE RISK AND CONDITIONS INVOLVED AND DO SO ENTIRELY OF MY OWN FREE WILL. I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE, OR THAT THIS WAIVER IS BEING SIGNED BY A PARENT OR LEGAL GUARDIAN.

Covid-19 Liability Release Waiver

I, the undersigned acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing.
I further acknowledge that Foundations Jiu Jitsu LLC has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19.

I further acknowledge that Foundations Jiu Jitsu  LLC cannot guarantee that I will not become infected with the Coronavirus/COVID-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, staff, and other clients and their families.
I voluntarily seek services provided by Foundations Jiu Jitsu LLC and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending class.
I attest that:
* I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
* I have not traveled internationally within the last 14 days.
* I have not traveled to a highly impacted area within the United States of America in the last 14 days.
* I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
* I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non-contagious by state or local public health authorities.
* I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.

I agree to inform Foundations Jiu Jitsu LLC if I test positive for Coronavirus/COVID-19 so that they may notify students, instructors, and other staff of potential exposure, and to follow current gym and public health guidelines on when I may return to class following a positive test.

I hereby release and agree to hold Foundations Jiu Jitsu LLC harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the gym, or that may otherwise arise in any way in connection with any services received from Foundations Jiu Jitsu LLC. I understand that this release discharges Foundations Jiu Jitsu LLC from any liability or claim that I, my heirs, or any personal representatives may have against the gym with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Foundations Jiu Jitsu LLC. This liability waiver and release extends to the gym together with all owners, partners, and employees.  I also affirm that if I am under 18 years of age, this waiver has been signed by a parent or legal guardian.
